|a يوجد التراضي بتطابق إرادتين (الإيجاب والقبول)، وذلك تعبيرا عن إرادة طرفي العقد. وعلى هذا الأساس تكون إرادة الطرفين جادة وعن وعي وإدراك في إحداث أثر قانوني، لأن التعبير عن الإرادة يعكس الرضا لدى المتعاقدين والتراضي في العقود الإلكترونية يجتاز نفس المراحل التي يجتازها التراضي في العقود التقليدية سواء من حيث وجود الإرادة، أو الإيجاب، أو القبول، أو تلاقيهما. وهو يخضع مبدئيا لنفس الأحكام إلا ما استثناه المشرع المغربي بموجب مقتضيات القانون رقم 53.05 المتعلق بالتبادل الإلكتروني للمعطيات القانونية اقتناعا منه بضرورة تحديث ترسانته القانونية بفعل التحولات الحديثة التي فرضت عليه سلوك هذا النهج التشريعي.
|b Consensus exists when two wills (offer and acceptance) match, as an expression of the will of both parties to the contract. On this basis, the will of both parties is serious, conscious and conscious in creating a legal effect, because the expression of will reflects the satisfaction of the contracting parties. Consensus in electronic contracts passes through the same stages as consent in traditional contracts, whether in terms of the presence of will, offer, acceptance, or their convergence. It is subject in principle to the same provisions, except for what the Moroccan legislator excluded under the requirements of Law No. 53.05 relating to the electronic exchange of legal data, out of his conviction of the necessity of updating his legal arsenal due to the recent transformations that forced him to adopt this legislative approach.
