|a تتعد أفعال المساس بسرية الأسئلة الامتحانية فمنها ما يظهر بصورة العمد ليكون الفعل ناتج عن علم وإرادة الفاعل، ومنها ما يكون بأحد الصور الخطأ المرتب للمسؤولية الجزائية غير العمدية، وجرم قرار مجلس قيادة الثورة رقم ١٣٢ لسنة ١٩٩٦ جريمة الإخلال بسرية الأسئلة الامتحانية بصورها السابقة ولم تعد مواجهة القرار لهذه الأفعال كافية مع الأخذ بعين الاعتبار المصلحة المعتبرة في التجريم والتي يوفر القانون لها الحماية اللازمة للحد من أفعال المساس بها، وكذلك تطور وتعدد وسائل الإعلام بصورة عامة والإنترنيت على وجه الخصوص الذي استخدم وبكثرة في ارتكاب هذه الجريمة إذ يؤدي استعمال هذه الوسيلة إلى سرعة وصول الأسئلة لأكبر عدد من الأشخاص، فضلا عن عدم قابلية الجزاء في تحقيق الردع العام والخاص للحد من ارتكاب هذه الجرائم. مما يقتضي الأمر تدخلا تشريعا عاجلا يحمي مرفق التعليم وينتشله من حافة الانحدار.
