|a تناولت الدراسة الضمانات القانونية التي تحمي الموظف العام من الجزاءات التأديبية في التشريع البحريني، حيث يعتبر الموظف العام اليد العامل للدولة في جميع نشاطاتها واحتياجاتها المتعددة والمتنوعة، لذلك يعد حمايته من خطورة الجزاءات التأديبية من أهم الموضوعات التي أهتم بها المشرع القانوني والقضاء الإداري من أجل تقرير العديد من الضمانات القانونية للموظف في مجال الجزاءات التأديبية، وهذه الضمانات لا تستهدف حماية خاصة للموظف المتهم فقط، بل تستهدف مصلحة عامة للمجتمع من خلال اظهار الحقائق وكفالة العدالة باعتبارها من حقوق الإنسان الطبيعية، والنابعة من روح القانون والعدالة التي كفلتها الدساتير والقوانين المختلفة، وتوصلت الدراسة إلى عدة النتائج ومنها أن المشرع أعطي السلطة المختصة التي ينتمي إليها الموظف مسؤولية إحالة الموظف المتهم إلى التحقيق وهي نفسها التي توقع الجزاءات التأديبية على الموظف المخالف للقانون. ومن أهم التوصيات نوصي المشرع القانوني بأن يقدم اقتراح بقانون لتعديل القصور التشريعي التي أصابت المرسوم بقانون الخدمة المدنية رقم ٤٨ لسنة ٢٠١٠ فيما يتعلق بمسالة الإغفال عن أحقية الموظف في الطعن على القرارات الإدارية أمام القضاء.
|b This study addressed the legal guarantees that protect the public employee from disciplinary penalties in Bahraini legislation. The employee is considered the working power of the state in its multiple and diverse activities. Therefore, protecting employees from seriousness of disciplinary penalties is one of the most important topics that the legislator and administrative courts have been concerned with to build up and adopt many guarantees for the employees in the field of disciplinary penalties. These guarantees are not only aiming specific protection of the accused employee, but also targeting the general interest of society by revealing mere facts and ensuring justice as one of the basic human rights which find its roots in the spirit of law and justice guaranteed by the various constitutions and laws. The study concluded to several results, which among that the legislator gave the competent authority to which the employee belongs the responsibility of referring the accused employee to investigation. The same authority may impose disciplinary penalties on the employee who violates the law. The study ended by many recommendations. which the most important among that the researcher suggests that the legislator submits a proposal to amend the legislative default of the Civil Service Decree Law No. 48 of 2010 to grant employee’s right to appeal administrative decisions before the concerned courts.
