|a يروم هذا البحث الإجابة عن سؤال مركزي: كيف تشتغل آليات الحجاج القانوني في وثيقة القانون 51.17 المتعلق بمنظومة التربية والتكوين والبحث العلمي بالمغرب؟ وللإجابة عن هذا السؤال الإشكالي سنهتدي بالإطار النظري والإجرائي الذي وضعته البلاغة الجديدة في تقعيدها للحجاج القانوني، وذلك بالتركيز على الصنافة الحجاجية التي خصصها شاييم بيرلمان لتأويل النصوص القانونية. وبما أن هذه الصنافة تضم ثلاث عشرة حجة قانونية، إضافة إلى أربع حجج أخرى أضافها الباحث بوليدور فابريغيد، فإننا سنقتصر فقط على ثماني حجج هي: الحجة بالأقوى، الحجة بالنقيض، الحجة بالمماثلة، الحجة بالمثال السابق، حجة الانسجام الحجة الغائية، الحجة السلطوية، الحجة الطبيعية.
|b This research aims to answer a central question: How do the mechanisms of legal argumentation operate in the Framework Law 17.51 concerning the system of education, training and scientific research in Morocco. To answer this question, we will follow the theoretical and procedural framework established by the new rhetoric through its study of legal argumentation. This is done by focusing on the Hajj category, which Chaim Perelman devoted to the interpretation of legal texts. Since this category includes thirteen legal arguments, in addition to four others added by the researcher Polydor fabregid, we will limit ourselves to only eight arguments: the argument by the strongest, the argument by the opposite, the argument by analogy, the argument by the previous example, the argument of harmony, the teleological argument, the authoritarian argument, the natural argument.
