|a الشروط المفترضة للجرائم الجنسية الإلكترونية هي أن ترتكب هذه الجرائم عبر الإنترنت عن طريق التقنيات الفنية الحديثة، فيقوم الجاني بارتكاب هذه الممارسات الجنسية غير المشروعة بواسطة وسائل التواصل الحديثة بدون لقاء مباشر بالضحية وفي كثير من الأحيان بدون سابق معرفة. وتتعدد صور الجرائم الجنسية الإلكترونية كالزنا الإلكتروني، أو الاغتصاب الافتراضي أو الدعارة الإلكترونية، أو التحرش الجنسي الإلكتروني، وكل هذه الصور ترتكب عبر تقنيات التواصل الحديثة. وفي هذه الجرائم تثار إشكالية انطباق النصوص الجنائية القائمة عليها، وفقاً لأن لكل جريمة من الجرائم الجنسية التقليدية لها نموذج قانوني معين لا يتطابق مع نموذجها الإلكتروني، مما يصطدم مع مبدأ شرعية الجرائم والعقوبات.
|b The assumed conditions for electronic sexual crimes are that these crimes are committed over the Internet using modern technical technologies, so the perpetrator commits these illegal sexual practices using modern means of communication without direct meeting with the victim and in many cases without prior knowledge. There are many forms of electronic sexual crimes, such as electronic adultery, virtual rape, electronic prostitution, or electronic sexual harassment, and all of these images are committed through modern communication technologies. In these crimes, the problem of applying the criminal texts based on them is raised, according to the fact that each of the traditional sexual crimes has a specific legal model that does not match its electronic model, which clashes with the principle of the legitimacy of crimes and punishments.
