|a تناول البحث بالدراسة موضوع أحكام الأمر الجزائي الواردة في قانون الإجراءات الجزائية الاتحادي رقم 38 لسنة 2022، وتم التعرض في المبحث الأول لماهية الأمر الجزائي وإبراز ذاتيته، وذلك بمقارنته بأنظمة شبيهة له، وخلصنا في تحديد طبيعته إلى أنه قرار قضاني، وبذلك فهو لا يرتب آثار الأحكام القضائية. وأما في المبحث الثاني، فقد تعرضنا فيه للأحكام القانونية للأمر الجزائي، وذلك بتحديد نطاقه من حيث الجرائم التي ينطبق عليها، والجهة المختصة بإصداره، ثم الضمانات القانونية المتعلقة به، ومن ذلك: ممارسة حق الدفاع، وتسبيب الأمر الجزائي وتعديله، والاعتراض عليه وغيرها.
|b The research addressed the study of the penal order contained in the Federal Criminal Procedure Law No. 38 of 2022. In the first section, we addressed the nature of the penal order and highlighted its specificity by comparing it to similar systems. We concluded that its nature is a judicial decision, and therefore, it does not entail the effects of judicial rulings. In the second section, we addressed the legal provisions of the penal order by determining its scope in terms of the crimes to which it applies, the competent authority to issue it, and the legal guarantees related to it, including: exercising the right of defense, reasoning the penal order, modifying it, objecting to it, and others. We concluded by recording a number of recommendations, including proposals to amend some provisions of the penal order.
