|a تكمن مشكلة هذا البحث في بيان ما نطاق الرقابة الدستورية على التشريعات (القوانين والأنظمة) عن طريق الدفع بعدم الدستورية؟ وما هو موقف قضاء المحكمة الدستورية الأردنية من موضوع حجية الأحكام الصادر عنها نتيجة هذا الدفع؟. فتبين معنا أن الرقابة على دستورية القوانين والأنظمة في الأردن قد تحولت على ضوء التعديلات الدستورية لعام 2011 وبعد صدور قانون المحكمة الدستورية لعام 2012 إلى رقابة إلغاء تمارسها جهة واحدة هي المحكمة الدستورية. لذا نتمنى على المشرع الأردني أن يخطو خطوة نوعية ليوسع قاعدة حق الدفع بعدم دستورية القوانين والأنظمة بأن يمنح الأفراد والهيئات القضائية والهيئات ذات الاختصاص القضائي (رئيس النيابة العامة والنيابة الإدارية)، والهيئات المختلفة في الدولة (كالنقابات والأحزاب والمجالس البلدية)؛ حق الطعن المباشر أمام المحكمة الدستورية بما يمس حقوق الإنسان أو يضر بمصالحهم.
|b The problem of this research lies in clarifying what is the scope of constitutional control over legislation (laws and regulations) by claiming unconstitutionality? What is the position of the judiciary of the Jordanian Constitutional Court on the issue of the validity of the rulings it issued as a result of this argument? It became clear to us that oversight of the constitutionality of laws and regulations in Jordan has transformed, in light of the constitutional amendments of 2011 and after the issuance of the Constitutional Court Law of 2012, into oversight of repeal exercised by one body, which is the Constitutional Court. Therefore, we hope that the Jordanian legislator will take a qualitative step to expand the basis of the right to argue that laws and regulations are unconstitutional by granting individuals, judicial bodies, bodies with judicial jurisdiction (the head of the Public Prosecution and the Administrative Prosecution), and various bodies in the state (such as unions, parties, and municipal councils); The right to direct appeal before the Constitutional Court regarding matters that affect human rights or harm their interests.
