المستخلص: أقام المشرِّع الأردني الضمان على الإضرار الذي يتميز عن الضرر، حيث الأخير تعبير عام يتسع ليشمل الإضرار ولا عكس، والضرر ينقسم إلى: الضرر غير المضمون، والضرر المضمون على فاعله، والأخير أسماه المشرع الإضرار. وإن مفهوم الإضرار الذي توصلنا إليه هو الفعل الذي يخلق ضرراً بالغير دون أن يكون استعمالاً لحق، وإن كان كذلك يكون استعماله غير مشروع، أو دون أن يكون مبنياً على جواز شرعي وأن لا تتوفر له أحد أسباب دفع المسؤولية. وإن تقسيم الإضرار إلى نوعين: المباشرة والتسبب، هو تقسيم لا طائل منه، لأن المشرّع بهذا التقسيم ينظر إلى أسباب الإضرار لا على نتائجه، والمسؤولية تبنى على النتائج لا على الأسباب. كما أنه لم يكن موفقاً بعدم تقييد المباشر بالإضرار بأي شرط، بل كان يتوجب تقييد ضمان المباشر بإمكانية إحالة الحكم عليه. والمباشرة يمكن أن تحصل بفعل إيجابي أو سلبي، ولكن المباشرة بفعل سلبي مشروطة بواجب، وامتناع المكلف عن القيام به، وضرر بالغير، وبهذا يتميز الإضرار بالامتناع عن مجرد الكف. وأخيراً يستوي في المباشرة أن يكون الفعل أتاه المباشر بنفسه، أو بشيء تحت يده، أو باستخدام شخص آخر دون إرادته كما في الإكراه الملجئ.

The Jordanian lawmaker established a warranty on the injurious act, which is distinct from injury. The latter term extends to include the injurious acts and not vice versa. The injury is divided into the unsecured injury and the injury secured on its conductor and is called the injurious act by the lawmaker. The concept of the injurious act that the researcher has reached is the act that is harmful to others without being an exercise of a right. If that is the case, then such an exercise will be illegal and the reasons for the abatement of responsibility are not available. The njurious act may be direct or causative. This division is useless, because the lawmaker looks at the reasons for the injurious act and not at the consequences, as the responsibility is based on the outcomes rather than the causes. The lawmaker was also not successful in restricting the person who commits the injurious act to any condition. Rather, the lawmaker had to restrict the liability of the injurer to refer the sentence on him. The direct injurious act may be committed by a positive or a negative act. However, the negative act is conditioned by a duty, the failure of the assignee to carry it out, and inflicted damage on others. By this, the injurious act of refraining is distinct from just quitting. Finally, the direct injurious act is equivalent to the act committed by the person himself, or by a tool under his command, or by using another person without his will as in the obliging duress.
