المستخلص: قد يتأخر المدن في تنفيذ التزامه للدائن، والذي يتمثل بالتزام محله مبلغ من النقود، لذلك يستحق الدائن عن هذا التأخير تعويضاً قانونياً يسمي الفوائد التأخيرية. ولقد عمل المشرع الأردني على المساواة في الفوائد التأخيرية بين العمل التجاري والمدني، وذلك على عكس بعض القوانين المقارنة كالقانون المدني المصري، وبالرغم من أن المشرع الأردني لم ينص صراحة على الفوائد التأخيرية بنص صريح في القانون الأردني، إلا أنه من خلال الفقرة الاولي من نص المادة (167) من قانون أصول المحاكمات المدنية الأردني يمكن الاستدلال على الفوائد التأخيرية. والضرر في حالة تأخر المدين عن تنفيذ التزامه هنا مفترض وغير قابل لأثبات العكس، ولتحقيق الفوائد التأخيرية لا بد من توافر بعض الشروط وهي أن يكون الدين معلوم المقدار وقت المطالبة، وأن يتأخر المدين في تنفيذ الالتزام، وأن تتم المطالبة، وأن يتأخر المدين في تنفيذ الالتزام، وأن تتم المطالبة به قضائياً، وقد يتداخل مفهوم الفوائد التأخيرية مع بعض الأنظمة القانونية المشابهة لها بالرغم من الاختلاف.
