المستخلص: إن ظاهرة اللجوء وقضية اللاجئين هي نتاج لإنكار حقوق الأفراد والجماعات والشعوب، وقد اهتمت الشرعة الدولية في معرض وضعها لضمانات حقوق الإنسان ومواجهة نتائج إنكارها وانتهاكها، بصفة خاصة، باللاجئين في العديد من الاتفاقيات والإعلانات، غير أن ما يشهده العالم اليوم حول وضعية اللاجئ الإنساني (تشرد، تردد معظم الدول في قبول طلب اللجوء، مخيمات تفتقد لأدنى شروط الحياة...)، يطرح العديد من التساؤلات خاصة ما تعلق منها بمبدأ عالمية حقوق الإنسان. وتأتي هذه الدراسة في هذا السياق، لتركز على المرجعية القانونية التي تحكم تعامل دول اللجوء مع اللاجئين، خاصة إذا أرادت هذه الدول التحجج باعتبارات السيادة وعدم الانضمام للاتفاقيات الدولية ذات الصلة للتنصل من مبدأ عالمية حقوق الإنسان.

The phenomenon of asylum and refugee issue is a result of the denial of the rights of individuals, groups and peoples, has focused on the International Bill in the gallery and put in place to guarantee human rights and face the consequences of denial and violations, in particular, refugees in many conventions and declarations, but what the world is witnessing today on the status of humanitarian refugees (displaced , most countries reluctant to accept his application for asylum camps lack the minimum conditions of life ...), it raises many questions especially those relating to the principle of universality of human rights. The study comes in this context, to focus on the legal reference that deal with refugees receiving countries control, especially if these countries wanted to invoke considerations of sovereignty and non-adherence to international conventions related to disavow the principle of universal human rights.
