المستخلص: نال حق اللجوء اهتمام الأوساط الدولية باعتباره أحد الحقوق التي أقرتها الشرعية الدولية لحقوق الإنسان، فقد نجح المجتمع الدولي عقب تكريس حق اللجوء في الإعلان العالمي لحقوق الإنسان لعام 1948 في إقرار عددا من المواثيق الدولية والإقليمية لتوفير الضمانات الأساسية لحماية اللاجئين وتكريس حقوقهم بشكل يمكنهم من العيش بكرامة وأمان. وفي ظل ازدياد معاناة اللاجئين وارتفاع حدة تلك المشكلة نظرا لما تشهده العديد من دول العالم من حروب ونزاعات نتج عنها تدفق أعداد هائلة من اللاجئين الباحثين عن الملاذ الآمن والكرامة، يلاحظ أن واقع التعامل مع قضية اللاجئين اليوم قد شهد تغيراً ملحوظاً بعزوف الدول عن استقبال اللاجئين وتنكر بعضها لحقوقهم المكرسة قانوناً، إضافة لما يعانيه اللاجئون من تعرض للمضايقات والاعتداءات والتمييز العنصري في بلدان الاستقبال. وهو ما يستدعي ضرورة التزام الدول بمسؤوليتها القانونية لتمكين اللاجئين من الحصول على حقوقهم وممارسة حرياتهم التي كفلتها مواثيق حقوق الإنسان والاتفاقيات الخاصة باللاجئين وعدم ردهم أو طردهم، إضافة لضرورة تكاتف أعضاء الجماعة الدولية لتفعيل مبدأ تقاسم الأعباء لتخفيف العبء عن بلدان الاستقبال، والسعي لإيجاد حلول دائمة لمشكلات اللاجئين.

The right of asylum has gained the attention of the international community as one of the rights recognized by the International Bill of Human Rights, the international community succeeded after devoting the right of asylum in the Universal Declaration of Human Rights of 1948 and in the adoption of a number of international and regional instruments to provide the basic guarantees to protect refugees and to devote their rights to live in dignity and safety. With the increase in the suffering of refugees and the problem nowadays because in many countries of the world wars and the resulting flow of huge numbers of refugees seeking safe haven and dignity, noted that the reality of dealing with the refugee issue today has witnessed a remarkable change, I must confess of States for the reception of refugees some denies their rights enshrined by law, in addition to the suffering of the refugees from the harassment and aggressions, racial discrimination in the countries of reception. This requires the need for the commitment of legal responsibility to enable refugees to obtain their rights and freedoms guaranteed by the human rights charters and conventions on refugees and non-refoulement or expulsion, in addition to the need for the solidarity of the members of the international community to activate the principle of burden-sharing to ease the burden on countries of reception, and seeking permanent solutions to refugee problems.
