|a يتناول هذا البحث دراسة مقارنة لمفهوم عقد العمل المرن كما ورد في مشروع قرار وزارة العمل والتنمية الاجتماعية السعودية، مع الإشارة إلى حقيقة هذا العقد، عقد عمل لبعض الوقت، أو عقد عمل بالتوقيت الجزئي، ومقارنته مع القوانين محل الدراسة، لذلك كان لا بد لنا من تعريف ذلك العقد وبيان خصائصه، وتوضيح الفارق بينه وبين عقد العمل التقليدي، وشرح وتحليل الأحكام المقترحة لتنظيم ذلك العقد، وبيان مدى ملاءمتها بالمقارنة مع أحكام عقد العمل التقليدي، واخيرا حاولنا أن نتلمس مدى تحقق الهدف الرئيس الذي سعى إليه مشروع القرار والمتمثل بخلق فرص عمل جديدة، وبالتالي مدى تحقيق مصالح أصحاب العمل والعمال. ومن أهم التوصيات التي خلصنا إليها ضرورة تحديد الأعمال والأنشطة التي يسمح لصاحب العمل إنجازها من خلال العقد المرن، بالإضافة إلى من العامل الحقوق والمزايا التي ينص عليها قانون العمل بما يتناسب مع ساعات عمل العامل في العقد المرن.

It should be noted that the subject of flexible work in accordance with the concept put forward by the Saudi ministerial draft resolution is a new topic, and therefore we did not find references dealing with the subject either from near or far, so we will rely on the analysis of the texts of the draft and criticism and make the appropriate recommendation on it.
