|a يتناول المقال إحدى أهم الإشكاليات المرتبطة بجهاز المجلس الدستوري، ألا وهي إشكالية تحديد الطبيعة القانونية له، حيث انقسم الفقه الفرنسي بشأنها إلى موقفين متعارضين، الأول يؤيد فكرة أن المجلس جهاز قضائي، يفصل في مسائل ذات طبيعة قضائية، والثاني يرى أن المجلس الدستوري هو هيئة سياسية بامتياز، لاعتبارات تاريخية ترتبط بتشكيل المجلس، ولم يبد المؤسس الدستوري الجزائري موقفا حاسما من هذه المسألة رغم التعديلات الدستورية المختلفة التي مست جهاز المجلس الدستوري، إلى حين صدور التعديل الدستوري لسنة 2016 أين يمكن أن نستشف منه أن المؤسس الدستوري الجزائري يميل إلى إصباغ المجلس الدستوري بصفة المؤسسة الدستورية العليا والمستقلة، وهو موقف نرى أنه يتجاوز الخلاف الدستوري التقليدي القائم بشأن هاته المسألة.

|f The article deals with one of the most important problems associated with the Constitutional Council, i.e., the problem of determining its legal nature. The French jurisprudence got divided into two opposing positions. The first supports the idea that the Council is a judicial organ, which decides on matters of judicial nature. The second considers that the Constitutional Council is a political body par excellence, because of historical considerations linked to the composition of the Council. The Algerian constitutional founder did not show a decisive position on this issue despite the various constitutional amendments that affected the body of the Constitutional Council until the promulgation of the constitutional amendment of 2016. Where can we discern from it, that the Algerian constitutional founder tends to place the Constitutional Council as the supreme and independent constitutional entity?
